Typically, when someone is arrested for an offense involving domestic violence or any type of offense where an injury has occurred, the court will issue an order of protection. Restraining orders can take on different forms, ranging from what’s often referred to as a refrain from or limited order protection, which requires the person who the order of protection is issued against to refrain from certain activities against the protected party, whether it be harassing, stalking, things like that. Whereas a full order of protection or sometimes referred to simply as a full stayaway order protection requires the person who the order is issued against to completely stay away from the protected party, their home place of business and things like that.

Orders of protection are very, very difficult because one could technically be arrested for being near someone, even if they didn’t fully realize at the time that they were in a location where the protected party was.
